By accessing or using this website and platform ("Service"), you agree to be bound by the following Terms of Use ("Terms"). Please read them carefully. If you do not agree with these Terms, do not use this Service.

1. Scope and Eligibility

• These Terms govern your access to and use of the website traice.eu, including any features, content, or services provided through it.
• Use of this Service is permitted only to persons who are legally capable of entering into binding contracts and are at least 18 years old.
• Commercial use of this platform, including access to real fleet data, OEM integrations, and recovery services - requires a separately executed Service Agreement and Data Processing Agreement (DPA) with DC Connected Car GmbH. These Terms alone do not constitute a commercial contract.

2. Purpose of Use

traice.eu is provided for evaluation, demonstration, and informational purposes. While users may explore features or interfaces of the platform, access to actual vehicle data or OEM integration requires a separately signed Data Processing Agreement (DPA).

No real-world vehicle connectivity, OEM data integration, or processing of personal vehicle data is permitted unless both a Service Agreement and a Data Processing Agreement (DPA) have been fully executed between the client organization and DC Connected Car GmbH.

3. User Accounts and Authentication

• To use parts of the platform, users may need to register an account. You are responsible for safeguarding your login credentials and agree not to share or transfer access to others.
• You must provide accurate and complete information during registration and keep it up to date.

4. Data Storage and Services

The platform is developed and hosted on Lovable Cloud, a European cloud infrastructure. Data is primarily stored and processed within the European Union (EEA). Where sub-processors involve infrastructure outside the EEA (for example, AWS cloud services), adequate protection is ensured through EU Standard Contractual Clauses (SCCs) per Art. 46(2)(c) GDPR. This includes:

• Lovable Cloud (for hosting, UI, authentication, and data management)

Basic user data (such as login credentials and activity logs) may be processed and stored within these services in accordance with our Privacy Policy and applicable data protection laws.

No personal vehicle data or sensitive telematics information is collected or processed unless covered by a DPA.

5. Intellectual Property

All content and technology available via traice.eu, including software, text, visuals, logos, and trademarks - are the intellectual property of DC Connected Car GmbH or its licensors.

You may not copy, distribute, modify, reverse engineer, or commercially exploit any part of the Service without prior written permission.

6. Restrictions on Use

You agree not to:

• Attempt to access vehicle data or system integrations unless authorized under a valid DPA.
• Use the platform for any illegal or unauthorized purpose.
• Introduce viruses, trojans, or any other malicious code.
• Copy or harvest information from other users or systems.

DC Connected Car GmbH reserves the right to suspend or terminate access if these Terms are violated.

7. Disclaimers and Limitations

This Service is provided "as is" without warranties of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or secure.

DC Connected Car GmbH is not liable for any indirect or consequential damages arising from the use of this platform, unless required by law.

8. Data Protection

All personal data is processed in accordance with applicable data protection laws and our published Privacy Policy.

Important: No actual personal vehicle data is processed through this Service unless both a Service Agreement and a legally binding Data Processing Agreement (DPA) are in place with DC Connected Car GmbH.

Where vehicle tracking and recovery services are activated under a DPA, the legal basis for processing vehicle location data includes Art. 6 Para. 1 lit. f EU GDPR / UK GDPR (legitimate interest of the fleet operator in property protection and enforcement of contractual obligations). Where this legal basis applies, affected data subjects have the right to object at any time pursuant to Art. 21 EU GDPR / UK GDPR.

Fleet operators activating recovery sessions acknowledge that real-time vehicle location data may be shared with authorized Recovery Agents (external third parties) for the duration of the session. Such sharing is time-limited, logged, and revocable. Full details are set out in our Privacy Policy and the applicable DPA.

9. Changes to the Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to this page with a revised "Effective Date." Your continued use of the Service after such changes constitutes acceptance.

10. Governing Law and Jurisdiction

• These Terms are governed by the laws of the Federal Republic of Germany.
• Exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is Ulm, Germany.
